Establishment of public and private sector companies

The Companies Act of 1956 laid down the rules for the establishment of both public and private companies. The limited company is the most commonly used form in India.  By registering the articles of association and memorandum with the state registrar of companies of the state, a company is formed .the state registrar of companies of the state, where the main office of the company is located is approached.

The approval of the name of the company is the first step in formation of the company .This approval of the name has to be done by registrar of companies in the state or union territory, in which the company will have its registered office. This approval is done if there is no company in the same name. The last name of the company has to add private limited or public limited depending on the public or private sector nature of the company. The owner of the company should mention at least four names for the company in order of preference. Then the registrar of companies informs the applicant within few days, whether the name proposed by the owner for his or her company is already registered or not.

If a name has been approved, then within six months the memorandum of association and articles of association with necessary documents should be filled. If one is not able to do so then application for renewal of name with some fee has to be submitted.
